Minutes:

Members of the Sub Committee were advised that since publication of the agenda, two conditions had been agreed with the objector therefore the requirement for the hearing had been dispensed with.

Section 100A Local Government Act 1072: Exclusion of the Press and Public

A Member of the Sub Committee is asked to move:-

 

“That in accordance with the provisions of Section 100A of the Local Government Act 1972, the press and public be now excluded from the meeting during the following item of business on the grounds that it involves the likely disclosure of exempt information as defined in paragraph 1 of part 1 of Schedule 12A of the Act and in respect of which the Proper Officer considers the public interest in maintaining the exemption outweighs the public interest in disclosing the information.”

Minutes:

RESOLVED

that in accordance with the provisions of Section 100A of the Local Government Act 1972, the press and public be now excluded from the meeting during consideration of the following item of business on the grounds that it involves the likely disclosure of exempt information as defined in paragraph 1 of Part 1 of Schedule 12(A) of the Act and in respect of which the Proper Officer considers that the public interest in maintaining the exemption outweighs the public interest in disclosing the information.

Hearing to consider whether a Licence Holder remains a fit and proper person to continue to hold a Personal Licence

Minutes:

The Chairman introduced himself and asked the Committee Members, Officers and those parties present to introduce themselves.

 

In attendance were the following:

 

Daveen Brown (Nottinghamshire Police - Responsible Authority)

Michelle White (Nottinghamshire Police - Responsible Authority).

 

The Council’s Legal Representative explained the procedure to be followed throughout the hearing. 

 

The Council’s Licensing Manager proceeded to submit the summary of evidence in relation to the Personal Licence Holder’s case and the initial decision taken in relation to this matter.

 

Following this and in accordance with adopted procedure, the Responsible Authority, Sub-Committee Members and Legal Officer were given the opportunity to ask questions of the Licensing Manager for the purposes of clarity and further explanation.

 

The Chairman then invited the Responsible Authority to put forward their representations to the Sub Committee.

 

Following this and again, in accordance with adopted procedure, the Licensing Manager, Sub-Committee Members and Legal Officer were given the opportunity to ask questions of the Responsible Authority for the purposes of clarity and further explanation.

 

Finally, the Chairman then invited the Licensing Manger and the Responsible Authority to sum up their respective cases.

 

The Chairman and Members of the Sub Committee then withdrew from the hearing in order to deliberate upon the application and representations made in respect of it.

 

The hearing was adjourned at 11.30am.

 

The Chairman and Sub Committee Members subsequently returned to the room and the hearing reconvened at 11.45am.

 

The Legal Officer delivered the Sub Committee’s findings, the decision and the reason as follows:-

 

RESOLVED

that the decision of the Licensing Sub Committee (in exercise of its powers delegated by Ashfield District Council as Licensing Authority), was to reduce the suspension of the Personal Licence to a period of three months.

The findings of fact and reasons for taking the decision were as outlined in the Licensing Sub Committee’s formal Decision Notice.

 

Appeal

The parties to the hearing were reminded that there is a right to appeal against the Sub-Committee’s decision, by way of the Nottingham Magistrates Court (address below), exercisable within 21 days of receipt of this notification.
