RESOLVED

that the minutes of the meeting of the Committee held on 17 March 2023 be received and approved as a correct record.

Committee Members were updated on the current position relating to the Sutton-in-Ashfield Recreation Grounds 2006 Charitable Trust, in respect of the exchange of land and the second trustee.

RESOLVED that

a)    the following be received and noted:

·         that the second Trustee (Roger Pratt) has retired from the Sutton-in Ashfield Recreation Grounds 2006 Charitable Trust, leaving Ashfield District Council as the continuing and sole trustee;

·         that the land held by the Charitable Trust, which includes the land at the Lammas Recreation Ground, will be held in the name of the Council as sole trustee, with the appropriate Charities Act restriction on disposition recorded on the title;

·         progress in relation to the exchange of land whereby the Charitable Trust will dispose of the part of the Lammas Recreation Ground identified in plan A attached, to Ashfield District Council and receive in return the part of Sutton Lawn Pleasure Ground identified in plan B attached, from the Council;

·         that external solicitors continue to be engaged to represent the Charitable Trust in respect of the land transactions to avoid the Executive Director Governance being in conflict when dealing with the Council’s interests as distinct to those of the Charitable Trust;

b)    the Executive Director Governance be authorised to consult with the public in relation to the proposed disposal of land at the Lammas Recreation Ground in accordance with its duties and as required by The Charity Commission.
